LaunchPad Zero – Legal Policies

This single document contains the legally binding Terms of Service, Privacy Policy and Cookie Policy (collectively, the “Policies”) for the website https://www.launchpadzero.com and the associated service “LaunchPad Zero” (the “Service”). 1. Terms of Service

1.1 Acceptance of the Terms

By accessing, browsing or using the Service, you (“User”, “you”, “your”) acknowledge that you have read, understood and agree to be bound by these Terms of Service and all additional guidelines incorporated herein by reference. If you do not agree, you must not use the Service.

1.2 Description of the Service

LaunchPad Zero is a rapid-development platform that designs, builds, deploys and scales Minimum Viable Products (“MVPs”). We publicly market the slogan “Ship your MVP in 7 Days”; this period is an average estimate only. Project start dates and delivery timelines vary based on internal queue prioritisation and resource availability, which are determined solely at our discretion.

We may provide certain functionality free of charge (“Free Tier”) until the User requests extra features, integrations or capacity, at which point paid plans or custom quotations will apply. Details of pricing and paid options will be presented to you for acceptance prior to any charge.

1.3 Eligibility & Account Registration

You must be at least 18 years old and legally capable of entering into contracts to use the Service. Account information must be accurate, complete and kept up-to-date.

All fees are due according to the payment terms presented at checkout or defined in a separate order form. Prices are exclusive of any applicable taxes, duties or VAT, which are your responsibility.

THE SERVICE, DELIVERABLES AND ALL ASSOCIATED MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT.

1.9 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUENGO AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF EUR 100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless Bluengo, its officers, directors, employees and agents from any claims, damages, losses, liabilities and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

1.11 Suspension & Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or we believe your use poses a risk to us or other users. Upon termination, your right to use the Service will cease immediately, but Sections 1.6–1.10 shall survive.

1.12 Changes to the Service or Terms

We may modify the Service or these Terms at any time. Material changes will be notified via the website or email with at least 14 days’ notice. Your continued use after changes become effective constitutes acceptance.

1.13 Governing Law & Jurisdiction

These Terms are governed by Spanish law. The courts of Barcelona, Spain shall have exclusive jurisdiction to settle any dispute arising from or in connection with the Service or these Terms, without prejudice to any mandatory consumer protection rules.
